Welcome to Martha. These Terms of Service ("Terms") govern your use of the Martha mobile application (the "Service"), operated by LEAD AWAKE LLC ("we," "us," or "our").

By creating an account or using Martha, you agree to these Terms. If you do not agree, please do not use the Service.

1. What Martha Is — and What It Isn't

Martha is a dream journaling and Jungian dream analysis tool. It uses artificial intelligence to generate interpretive reflections on the dreams you record, drawing on the tradition of depth psychology.

Martha is not therapy. The analyses Martha provides are reflective, interpretive, and educational in nature. They are not medical advice, psychiatric advice, psychological diagnosis, or treatment. Martha is not a licensed mental health professional, and using Martha is not a substitute for working with one.

If you are experiencing a mental health crisis, suicidal thoughts, or any urgent psychological distress, please contact a qualified professional, a crisis hotline, or emergency services in your area. In the United States, you can reach the 988 Suicide and Crisis Lifeline by calling or texting 988.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use Martha. By creating an account, you confirm that you meet this requirement.

If you are between 13 and 18, you may only use Martha with the consent and supervision of a parent or legal guardian. Martha is not designed for, marketed to, or intended for use by children under 13.

4. Your Content

You retain full ownership of all dreams, notes, and other content you submit to the Service. By using Martha, you grant us a limited license to process your content solely to provide the Service to you. We do not claim ownership of your content and do not use it for any purpose beyond delivering the Service.

Martha offers subscription plans billed on a recurring basis. Subscriptions renew automatically unless cancelled before the renewal date. Payments are processed directly through the Apple App Store or Google Play.

Refunds are handled in accordance with the refund policies of Apple and Google respectively. We do not process refunds directly.

7. Intellectual Property

Martha and its associated content, features, and functionality are owned by LEAD AWAKE LLC and protected by applicable intellectual property laws. Nothing in these Terms grants you rights in Martha's intellectual property beyond what is needed to use the Service.

8. Third-Party Services

Martha uses Supabase for data infrastructure and Anthropic's Claude language model to generate dream analyses. Your use of Martha is also subject to the terms and privacy policies of these providers. Dream content sent for analysis is processed in accordance with Anthropic's API terms and is not used to train their models.

9. Disclaimer

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. We do not guarantee that the Service will be error-free or uninterrupted.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amounts you paid us in the 12 months preceding the claim.

11. Governing Law & Disputes

These Terms are governed by the laws of the State of Oregon. Any disputes shall be resolved in the Multnomah County Circuit Court, Portland, Oregon.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
